Development Description:
Invalid: O’Connor Kerry Haulage Limited of Parkview House, Knockawaddra, Tralee, Co. Kerry intends to apply for Planning Permission at Aghabeg Middle, Lixnaw, Co. Kerry to import greenfield soil and stone By-Product, as defined in the National By-Product Criteria for Greenfield Soil and Stone (BP-N002/2024), to raise the level of existing lands by filling using inert greenfield soil and stone by-product in order to improve the agricultural value.
The site comprises an area of 8.865 hectares. It has been estimated that the up to 105,000 tonnes of imported infill material will be required to reach the desired final finished levels presented in drawings 24/074/006 to 24/074/010 inclusive. Final tonnage will be determined by compaction and settlement of imported fill such that the finished site level is as per drawings attached to this application
Work undertaken by Axis Environmental determined that the land in question does not fall within the remit of a development consisting of drainage and/or reclamation of wetlands.
The ‘Screening for Appropriate Assessment & Natura Impact Statement (NIS)’ report in relation to the proposed infill activity. concluded that beyond reasonable scientific doubt, in the view of best scientific knowledge, on the basis of objective information and in light of the conservation objectives of the relevant European sites, the proposed project, individually or in combination with other plans and projects, would not be likely to have a significant effect on any European sites including that of the Lower River Shannon SAC, given the proposed mitigation measures
The fill plan for the site provides for a 5m setback from all open land drains. No material will be infilled in the set-back area. Infill material will be gradually tapered upward from the edge of the set back area set back area towards the infill area.
The production process which generates the greenfield soil and stone by-product will comply with the criteria set out in Part 1 of Annex I of BP-N002/2024.
The quality of the greenfield soil and stone by-product from the production process will comply with the criteria set out in Part 3 of Annex I of BP-N002/2024.
The acceptance of greenfield soil and stone by-product at the use development will comply with the criteria set out in Part 4 of Annex I of BP-N002/2024.
The producer, holder and end user will comply with the requirements set out in Section 8 (Compliance) of BP-N002/2024
